Warranty

In this Warranty:

We, us, or our means MuscleSquad Limited, a company registered in England and Wales, with a company registration number of 10714754. Our contact details are set out at the end of this warranty.

You, or your means the purchaser of Products from us.

Product means the products that were supplied to you by us pursuant to the Terms and Conditions and which were purchased in the United Kingdom.

This warranty is attached to and forms part of the Terms and Conditions.

1 Warranty

1.1 We provide this Warranty to you in addition to any rights or remedies you have under the Consumer Rights Act 2015 or any other applicable law (Consumer Law Rights).

1.2 Subject to the terms of this Warranty and unless otherwise set out on our website or at the point of sale, if any Product proves defective by reason of improper workmanship or materials, we will repair or replace the Product or issue a full or partial refund to you with respect to any amount paid for the defective part (or all) of your Product.

1.3 This Warranty will apply to all Products purchased on or from 1 November 2023, from the date of purchase and for the following Warranty Periods:

1.4 If any materials, parts or features required to facilitate any repair or replacement pursuant to clause 1.2 are unavailable or no longer in production, or your model of Product is no longer available or in production, we will use our best endeavours to use appropriate equivalent materials, parts, features or model.

2 Packages

2.1 We offer packages and bundle deals as a promotional tool in order to give you the best value. Products included in our package and bundle deals may also be available for individual purchase, and each product in the package can generally be used without the other Products.

2.2 Where you purchase a Product as part of a package or a bundle deal, and a Product in the package is deemed defective under this Warranty, we will repair or replace that Product or issue a partial refund to you in respect of the value of that Product in the package only. The value of a particular Product in a package may be less than its full value had you purchased the Product individually. For the avoidance of doubt, we will not issue a refund for the other items in the package where they are not defective.

3 Making a valid warranty claim

3.1 To claim the benefit of this Warranty, you must:

(a) notify us by email as soon as you become aware that the Product is defective and in any event, within 14 days of receiving your order that the Product is defective with evidence of proof of purchase of your Product from us and a description and photographs of the claimed defect;

(b) if we ask you to, you must return to return the Product together with all packaging, accessories and documentation to the contact details set out below; and

(c) provide any other information reasonably required by us to assess your claim.

3.2 Where you return the Product as part of a Warranty claim under clause 2.1, you will need to cover any associated costs of returning the Product to us and where we find the Product is covered by this Warranty, we will refund any reasonable associated costs of you returning the Product to us. We recommend that you use a tracked delivery method.

4 When this warranty applies and when it does not

4.1 This Warranty does not cover any defect which is caused (or partly caused) or contributed to, by any:

(a) failure by you to care for the Product in accordance with any care instructions provided by us or made available on our website;

(b) loss, damage, moisture, sweating, theft, act or omission, accident or negligence by you or any third party not engaged by us;

(c) improper storage of your Product, resulting in damage caused by weather (including rusting of the Product where it is kept outdoors, or kept in an uninsulated room such as a garage or a shed);

(d) use of your Product otherwise than for any use specified by us;

(e) continued use of your Product (where such use is not reasonable) after any defect in your Product becomes apparent or would have become apparent to a reasonably prudent person;

(f) failure by you to notify us of any defect in your Product within a reasonable period of time after you become aware of or ought to have reasonably become aware of the relevant defect;

(g) reasonable wear and tear of your Product;

(h) act of God or force majeure event (including but not limited to war, riot, invasion, act of terrorism, contamination, earthquake, flood, fire, or other natural disaster, or any other event or circumstance beyond our reasonable control); or

(i) installation, repair, replacement, maintenance, altering, overhauling, dismantling or otherwise compromise of the Product by you or any person other than us.

4.2 Additional Expenses: Any works or services requested by you to be performed by us (including any work or services that are additional to repairs carried out by us pursuant to clause 1.2 and deemed by us to not be covered under this Warranty may incur additional charges, which we will advise you of prior to commencing those additional work or services. We are under no obligation to perform any additional work or services that you may request.

5 General

5.1 Terms and Conditions prevail: This Warranty is subject to the Terms and Conditions and in the event of any inconsistency or ambiguity between this Warranty and the Terms and Conditions, the Terms and Conditions will prevail.

5.2 This Warranty is only valid and enforceable in England and Wales and is governed by the laws of England and Wales.

5.3 No third party reliance: The benefit of this Warranty is for you only, and no other person or third party can rely on or make a claim under this Warranty, including if you resell your Product.

5.4 No Assignment or transfer: This Warranty or the benefit under this Warranty cannot be assigned or transferred to any other person or third party.

5.5 Severance: If any provision of this Warranty is held to be void, invalid or illegal or unenforceable in any jurisdiction, that provision is to be read down as narrowly as necessary to allow it to be valid or enforceable, failing which, that provision (or part of that provision) will be severed from this Warranty without affecting the validity or enforceability of the remainder of that provision or the other provisions in this Agreement.
